1. Agreement to Terms

By accessing or using DSCR Pulse (“Service”), operated by DSCR Pulse LLC, a Wyoming limited liability company, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

DSCR Pulse is available to anyone 18 years of age or older. The Service provides informational comparison tools and does not constitute financial advice.

3. Business-Purpose Restriction

DSCR Pulse is intended solely for the analysis of non-owner-occupied investment property loans for business or commercial purposes. This Service is not intended for loans secured by a property used or intended to be used as the borrower's primary residence, second home, or for personal, family, or household purposes. By using this Service, you represent that your use relates to a business or investment purpose.

4. Nature of the Service

DSCR Pulse is a software tool that provides DSCR loan analysis and lender comparison data for informational and comparison purposes only. You acknowledge and agree that:

  • DSCR Pulse is not a lender and does not make lending decisions.
  • DSCR Pulse does not provide financial, legal, or investment advice.
  • Rate and lender data displayed is for informational and comparison purposes only and does not constitute a commitment to lend, a rate lock, or a guarantee of any terms.
  • All rates, terms, fees, and eligibility criteria are subject to change without notice and must be verified directly with the applicable lender before relying on them.
  • You are solely responsible for verifying all information and conducting your own due diligence.

5. Account Registration

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

6. Pricing

DSCR Pulse is currently free to use. If we introduce paid features in the future, we will provide advance notice and updated terms.

7. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated means to extract data from the Service.
  • Redistribute, resell, or sublicense any data, analysis results, or content from the Service.
  • Attempt to reverse-engineer, decompile, or derive source code from the Service.
  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Misrepresent DSCR Pulse output as official lender quotes or commitments.
  • Share account credentials or allow unauthorized access to your account.

8. Intellectual Property

All content, features, functionality, software, designs, and trademarks of DSCR Pulse are owned by DSCR Pulse LLC and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, or create derivative works from our Service or its content.

9. Account Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason. Upon termination, your right to use the Service ceases immediately. We are not liable for any loss of data resulting from account termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA OR ANALYSIS IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DSCR PULSE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless DSCR Pulse LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Wyoming. Each party shall bear its own costs. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
